What do we do?
We are a Recruitment Agency and Recruitment Business as defined in the Employment Agencies and Employment Business Regulations 2003.Our core business activities and services are to assist candidates in finding permanent, temporary or contract employment. In order to do this, we find candidates work with our active or prospective clients, either directly or through supply by us. In addition to this, we assist our clients by introducing or supplying candidates for their active or prospective vacancies. Additionally, we recruit staff to work internally for us for the provision of our recruitment services.

Information we collect
In order for Tempting Recruitment Solutions to carry out our business as a Recruitment Agency and Recruitment Business, we obtain personal information for the following categories of people:
prospective and placed candidates, prospective and live client contacts, supplier contacts to support our services, and Employees’ and active temporary workers’.
Your personal information is obtained through a variety of different methods such as: you may have applied for a vacancy advertised by us, you may have directly registered with us in person, filled in our application form, via our website, via e-mail or telephone correspondence, you may have registered your details to a job board or social networking site for job seeking purposes, from a third-party i.e. a referral from a candidate or client; or a registered organisation when performing background checks such as a Disclosure and Barring Service (DBS) or reference check.
In instances where we have or are required to obtain your information from a third-party source we will always seek your consent prior to performing the aforementioned background checks and/or to seek your permission to us contacting you about our services. We will always ensure to inform you of the originating source of where we obtained your personal data i.e. in the case of a referral from another candidate or where we have obtained your personal information from a job board or social media platform. The personal data that we may obtain but is not limited to, are as follows: your name and date of birth, contact information namely your address, telephone number(s) and e-mail address, financial information (for the purposes of processing any payments or payroll and will only be obtained should you enter into a contract with us), eligibility and Right to Work information, proof of National Insurance emergency contact details, your marketing preferences (such as: the type of employment you are seeking, the locations you wish to consider for employment, the salary/wage you wish to consider for employment, your availability for any interviews, or to commence employment, and your preferred method of contact)professional history (which includes but is not limited to your CV, references, education, relevant qualifications or courses undertaken), your health records and/or any disclosure and barring service (DBS) checks, where applicable.

How we use the data we obtain
We use, store and process data which may include your personal data, for the provision and improvement of our Recruitment Services; to you and our clients and to comply with our legal obligations.The following is a list is what we do with the data we obtain (please note that the list is not exhaustive and may be changed): collecting and storing your personal information, whether in manual or electronic files, assessing and reviewing your suitability for job roles, contact you about prospective job opportunities, introducing and/or supplying you to actual or potential clients, sending your information to third parties with whom we have or intend to enter into arrangements which are related to our Recruitment Services, use your personal data to administer payroll, to retain records of our dealings with candidates, clients and third parties, collate market or sector specific information, to provide information to regulatory authorities and statutory bodies along with our legal providers and insurers where necessary.
We regularly monitor and review the performance of our service and officials to ensure we are providing a quality service to our customers, and to ensure that our service is compliant with our legal obligations and is in line with best practices. This means that we review our databases which contain your personal information, and any feedback you provide to us in order to assist with any training we provide or any updates in our processes that we may undertake.Where you have given us consent, we may send you promotional messages, marketing, advertising and other information we may think is of interest to you. This can include information on any vacancies we may think is of interest to you, information on any referral schemes we may have, competitions, events and surveys to help improve our services.

Entering in to and performing a contract with you
You are under no obligation to undertake any dealings with Tempting Recruitment Solutions; however, in order to provide our Recruitment Services, we may enter into a contract with you and/or a third party. please be advised that should you wish to undertake any dealings with Tempting Recruitment Solutions for the purpose of using our services to gain employment, that the aforementioned personal data is necessary for us to carry out our Recruitment Services to an adequate level and comply with our legal obligations as a Recruitment Agency and Recruitment Business as defined in the Employment Agencies and Employment Business Regulations 2003.A contract will contain obligations on both your part and our part and we shall process your personal information as is necessary for the purpose of those obligations. For example, in order to process payroll, a national insurance number and bank details will be required.

Legal obligations
We must comply with a number of statutory provisions when providing our Recruitment Services, which necessitate the processing of personal data. These include the Conduct of Employment Agencies and Employment Businesses Regulations 2003, which amongst other things requires us to: verify your identity, assess your suitability for an external job role, maintain records for specific periods.
Where we engage a person to work for us (whether directly or as supplied to a client), there are other statutory obligations that must be complied with including payroll, tax, social security, HMRC reporting requirements, and any other law or regulation.

Sharing your personal data
In order for us to provide an effective service and operate our business as a Recruitment Agency and Recruitment Business as defined in the Employment Agencies and Employment Business Regulations 2003, it is necessary for us to share your personal information with a selection of our trusted third parties, partner organisations, clients and service providers.The following is a list of the type of individuals, clients, bodies, organisations or trusted third parties with whom we may share your personal information with. Please note that this list is not exhaustive: clients or prospective employers, for the purpose of introducing prospective candidates, candidates, for the purpose of arranging interviews and temporary, permanent or contract assignments, clients, business partners, suppliers and sub-contractors, for the performance and compliance obligations of any contracts we may have/or enter in to with them or you, sub-contractors, such as, but is not limited to marketing specialists, event organisers or financial service providers, Analytics and search engine providers to assist with the performance and improvement of our services which includes our website, credit reference agencies, our insurance broker, compliance partner and other sub-contractors to help assess your suitable for a role where this is a condition of us entering in to a contract with you, third parties who provide services on our behalf, such as reference checks, qualification and criminal record checking services, right to work checks and skills testing. Regulatory or law enforcement agencies, when required by law to do so.
For operation purposes we would share your personal information to service providers such as: (this list is not exhaustive): IT support, cloud platforms to host and store our data, training providers and platforms, legal and professional advisers, background screening providers, insurers and auditors,Managed Service Providers (MSPs) or Recruitment Process Outsourcing services (RPOs).
Some of the organisations and clients, we work with outsource their recruitment function to other organisations called Managed Service Providers or Recruitment Process Outsourcing services. In order for us to submit you to a vacancy at the organisation we need to work through these third parties who will process your data and application on the organisation’s or client’s behalf. We will always have contractual agreements in place to ensure your personal information is fully protected and your same right apply.

Legal requirements to share your personal information
In certain circumstances we may be required by regulators or law enforcement agencies, to provide information to them in order to: prevent or detect criminal offences or fraud, to prevent harm or as part of other investigations where there is a legal basis for doing so. Why we share your personal information
As a Recruitment Agency we introduce candidates and clients for temporary, permanent or contracted employment. The exchange of personal information of our clients, service providers and candidates are an essential and a fundamental part of facilitating this process.
